A hearing will be held in January in relation to a lawsuit filed by the widow of the late
Judge Kevin Mullins who was shot and killed at the Letcher County Courthouse last
year, a crime for which former Letcher County Sheriff Mickey Stines is accused.
Judge Mullins’ widow Kimberly Mullins is suing three Letcher County Deputies claiming they should have known Stines was mentally ill and stopped the shooting.
The Mountain Eagle reports the three have filed a motion to dismiss the charges, saying there is no allegation that they knew he planned the shooting.
They also say there is precedent from previous court rulings they have no duty to warn.
The hearing is January 7.
