There’s been another wrinkle in the impending trial of three men charged in the death of Amber Spradlin in Prestonsburg in 2023.
Jury selection is set to start Tuesday for MK McKinney for murder and Michael McKinney and Josh Mullins for evidence tampering but the prosecution wants another delay for DNA evidence to be ready from the very busy state crime lab.
Attorneys for Mullins and Michael McKinney support the delay because the DNA could point to someone else.
MK McKinney’s lawyer says no delay because he has a right to speedy trial.
But the attorneys for Mullins and MK McKinney are married and they work for the same law firm.
The judge said Wednesday that their opposing opinions on the delay results in a conflict of interest they must sort out or get their clients to legally sign off on.
