The attorney for a man arrested last week for the murder of a Prestonsburg woman in 2023 wants his charges dismissed.
M.K. McKinney is charged with murder and tampering with physical evidence in the death of Amber Spradlin.
This week McKinney’s attorney filed a motion to dismiss the whole case claiming authorities did not follow proper procedures in obtaining the indictments and that the secrecy of the grand jury proceedings was violated, pointing out that police and the media seemed aware of the indictments before they were announced.
The attorney also wants McKinney’s $5 million full cash bond to be reduced, calling it excessive compared to others facing similar charges.
Once the prosecution files a response the judge will issue a ruling.
